Legal shield for gun shops returning firearms

The law protects a gun shop that returns a stored gun to its owner when the agreement ends. This protection does not cover any illegal conduct in the return. A person cannot be sued for refusing to enter a firearm hold agreement.

Rules for gun shops storing firearms

Gun shops can store a lawfully owned gun only with a written firearm hold agreement. The shop must contact the owner every 6 months until the gun is returned. By January 1, 2026, the Department of Public Safety provides a standard agreement form. The form must name a family member or other lawful person who can take the gun if the owner dies, with proof. The Department also writes routine rules to carry out this law. A firearm hold agreement is a written deal to hold an owner’s lawfully possessed gun for a set time at the owner’s request.
