Clear rules for abandoned storage units

Starting May 30, 2025, the law defines when a storage unit counts as abandoned. A unit is abandoned if it is unlocked and empty. It is also abandoned if it is unlocked and holds property worth less than $750. It is abandoned if you surrender possession and rights to the operator. It is abandoned if property remains more than 15 days after a written termination or nonrenewal notice. When a unit is abandoned, the operator may sell or dispose of the property under the statute.

Digital agreements and notice rules for storage units

Starting May 30, 2025, a rental agreement can be delivered and accepted electronically. A rental agreement is any written agreement that sets the rules for using a unit. Operators must send you notices by e‑mail or regular mail to your last known address or an address you listed in the agreement. Notices to the operator go to the facility address unless the agreement lists a different address. Mailed notices count as delivered when given to the U.S. Postal Service with the correct address and postage. If an agreement is delivered by hand, first‑class mail, or e‑mail and you do not sign within 30 days, paying rent or continuing to use the unit counts as acceptance, enforceable as if signed.

Storage auctions can be held online

Starting May 30, 2025, sales of stored property may be held at the facility, at the nearest suitable place, or online. This confirms that online auctions are allowed. It gives operators more ways to sell property after default or abandonment.
