Beginning July 1, 2025, towns that use impact fees must publish a policy that explains when a project needs new infrastructure and how the builder’s share is calculated. They must post it at the town office or on the town website. Any fee must be based on actual costs and be proportional to the project’s use. Towns must commit collected fees within 360 days and spend them in line with their capital plan.
Beginning July 1, 2025, a town can require off-site infrastructure or charge an impact fee instead. A town must pass an ordinance to use this power. Fees can be set so builders pay the entire cost. Towns can bill before or after the work. Covered items include water, sewer, solid waste, public safety, roads, parks, and schools.
