Spread pricing banned for Maine health plans

The law bans spread pricing by health plan carriers and pharmacy benefit managers in Maine. Spread pricing means charging more than the drug’s ingredient cost plus the dispensing fee, minus any PBM fee. A PBM fee must not be more than the value of the services performed. The ban applies to contracts entered into or renewed on or after January 1, 2026. Each year by December 31, carriers and PBMs must have the CEO or CFO certify compliance to the Superintendent. The Superintendent enforces the ban under state law. This section is repealed on January 1, 2031.

MaineCare exempt from spread-pricing ban

The spread-pricing ban does not apply to the MaineCare (Medicaid) program. MaineCare drug payments are outside this rule from January 1, 2026 until January 1, 2031.
