Out-of-state doctors can order home health care
Maine home health agencies can give you care for up to 90 days based on an order from a doctor licensed in another state. The agency must be licensed in Maine, certified by Medicare and Medicaid, and keep proof the doctor’s license is in good standing. The doctor must have done an in‑person physical exam of you in the state where the doctor is licensed, and your care must match what that exam found. The doctor is exempt from getting a Maine license only to place this order, may use telehealth only with you, cannot treat other Maine patients, and must order from a Medicare/Medicaid‑certified home health agency while you are receiving services. Providers and doctors must follow state rules and federal home health standards. If a doctor breaks these rules, the Department of Health and Human Services, with the medical boards, can remove the doctor’s exemption, and the Department can make rules to carry out this law.
