If your Maine plan covers prescriptions or outpatient care, it must cover FDA-approved birth control to prevent pregnancy, including prescription methods and over-the-counter oral hormonal and emergency pills. You pay no deductible, copay, or coinsurance for these supplies. Your plan must cover up to a 12-month supply; for prescriptions, your prescriber may give it all at once or in parts. This does not apply to limited-benefit plans like accident-only, specified disease, hospital indemnity, Medicare supplement, disability income, or long-term care plans. Starts January 1, 2026.
You do not need a prescription to buy FDA-approved oral hormonal or emergency birth control sold over the counter in Maine. Your plan must let you get them at the pharmacy without paying at the register, or you can pay and file for reimbursement. Plan documents must clearly explain the steps to use these options. Starts January 1, 2026.
These rules apply to policies executed, delivered, issued for delivery, continued, or renewed in Maine on or after January 1, 2026. Contracts count as renewed no later than their yearly anniversary, so most plans must follow them by then.
The state provides $62,016 from the General Fund and $21,571 from the Highway Fund for fiscal year 2026-27 to carry out this law. The money supports agency work to set and enforce the coverage rules.
