Union protections for county deputies
A sheriff’s choice not to reappoint a deputy must follow the dismissal procedures and standards in the deputy’s union contract. This applies unless the decision is at the end of the deputy’s probationary period. The probationary-period exception still stands.
Rules for sheriff vacancies and acting chief
When a sheriff’s term is vacant and that sheriff was nominated in a primary, the Governor must pick an appointee from the same political party. If the county party committee sends one or more names, the Governor must choose from those names. If the committee sends recommendations and the chief deputy is in the same party, the chief deputy must be considered. While the office is vacant, the chief deputy has the same powers and duties as the sheriff until the vacancy is filled under the Maine Constitution and the new sheriff has qualified.
