New registration and staffing checks for temporary nurse agencies

Temporary nurse agencies in Maine must register with the Department and renew every year. You must update registration after any change in ownership, operation, or location. Online platforms that place temporary nurses are included; Maine-licensed home health agencies are excluded. Agencies must ensure each worker meets state and federal qualifications and has appropriate experience. Use the Background Check Center for direct access workers and keep records of credentials, shots, and required training. Provide those records to the Department on request and to facilities when they make a justified request under Department rules.

Settle violations by consent with the Department

The Department can resolve matters by a consent agreement with an applicant or registrant. The applicant or registrant, the Department, and the Attorney General must all agree. Agreements can include any remedy, penalty, or fine allowed by law, even those usually ordered by a court. This lets the parties resolve matters without further proceedings.
