Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Clear rules for private parking fines

The law sets clear rules for private parking fines on lots open to the public. No one may charge or collect a fine unless they follow these rules. Fines must be reasonable and posted where drivers can see them at every entrance and exit. The company must send a written notice to the car’s registered owner with the date, time, rule broken, amount, how to pay, and contact info. You get at least 10 business days to pay.

License plate readers banned at parking lots

Parking lots open to the public may not use automated license plate readers. Limited exceptions in state law apply (Title 29-A, section 2117-A). This protects your privacy and limits automated tracking.

Triple damages for unfair parking charges

A parking charge made in violation of this law is an unfair trade practice. If you are harmed by an unlawful charge, you can recover three times the unlawful amount. You may also use other remedies under the state’s unfair trade law.
