Higher approval threshold for new health facilities

The law raises the capital cost that triggers a certificate of need from $3,000,000 to $5,000,000. It applies to new health care facilities other than nursing facilities, including ambulatory surgical centers. Starting January 1, 2027, the Commissioner updates this dollar amount each January 1 using the medical care services Consumer Price Index. Projects at or under the current threshold do not need CON review. Projects over the threshold still must apply.
