Clear consent and minor rights for HIV tests
HIV testing is voluntary. You are told in person or in writing unless you decline. You get basic info on HIV and what results mean, and can ask questions. Minors can consent without a parent. If you decline, your provider records it. The ordering provider must get any results. Repeat tests that monitor a known infection do not need this consent step.
Only treating providers can see HIV results
If you authorize sharing for care, only providers directly treating you can see your HIV results. They can use them only for your medical or dental care. Providers who share in good faith under this rule are protected from civil or criminal liability.
HIV test info shared for insurance billing
Your HIV testing information can be shared to get insurance to pay the bill. This helps with claims and reimbursement. It also means insurers can see your HIV testing information.
