Water districts can borrow; towns must repay

The law lets a water district created by special act borrow before it misses payments. It may do this only if it reasonably finds that expected revenues from normal water charges from now through the end of the current fiscal year will not cover expected operating expenses for that same period. In that test, it must count all other cash or funds it holds as revenue and include all expected or obligated costs, including any duty to refill a reserve fund. The board can issue the district’s warrant at once to the towns in the district to repay the borrowed amount plus interest. Within 30 days after issuing a warrant, the district must send a financial plan to the Maine Public Utilities Commission and each town; the commission must allow town input and may open a review. These powers apply only where the towns have already approved this section or the earlier law, or after approval under subsection 6.
