Tougher crimes and prison for AI child abuse images
Beginning April 16, 2026, it is a Class B crime to make or alter images to create obscene child sexual material, including with AI. It is a Class C crime to share it or to have it with intent to share. It is also a crime to transport, buy, possess, or access it with intent to view. Courts must impose at least 5 years in prison for key offenses, and at least 10 years when certain prior convictions apply. Material showing anyone under 16 is contraband and can be seized. If the minor is 14 or 15 and the actor is less than 5 years older, a close‑in‑age exception can apply.
Clear rules cover AI-made child abuse images
Beginning April 16, 2026, the law defines child sexual abuse material to include any image that shows, or looks like it shows, a minor in sexual conduct. This includes computer‑made images and photos that are changed to look like a child. The law defines generative AI, what counts as an image, and who is an identifiable child. It also sets a three‑part test for what is obscene. These definitions guide what content is illegal and what courts may seize.
Higher bar to infer intent to share
Beginning April 16, 2026, the court may infer intent to share only if someone has 100 or more images. Before, the rule applied at 10 or more images.
Minor now means under age 16
Beginning April 16, 2026, a minor means someone under age 16 for laws that use this term. People who are 16 or 17 are no longer treated as minors under those rules. This narrows who is covered in related prosecutions and requirements.
