New limits and license repeal for cultchless oysters

Beginning June 10, 2025, the law bans taking, possessing, or selling a bulk pile of American oysters when 20% or more are cultchless. Inspectors count a random sample of 1 to 4 pecks from different parts of the pile, or the whole pile if it is under one peck. You may go over 20% if the oysters were legally taken under a municipal shellfish conservation ordinance authorized by section 6671 that regulates American oysters and has a Department of Marine Resources transplant permit. People licensed under section 6810-B may take, possess, or sell cultchless oysters from an aquaculture lease or license site under sections 6072, 6072-A, 6072-B, or 6072-C. People licensed under sections 6851 or 6852 may possess, buy, and sell them. This limit does not apply while you work on your own aquaculture lease or license site under the 6072 series. The separate cultchless American oyster growers license in section 6863 is repealed, and any rights under that license end.
