The law lets the Department of Environmental Protection cancel a Site Location of Development permit for projects that are not subdivisions, as defined when the permit was issued. If the permittee never built or operated the project, the department can treat the permit as not used or rescind it. The department can also rescind the permit after the site is fully decommissioned to the department’s satisfaction. Fully decommissioned means all above- and below‑ground parts are removed, the ground is back to preconstruction grade, native plants like nearby areas are replanted, and all waste is recycled or taken to an authorized facility.
