Expired protection orders can be reinstated

If your final protection from abuse order expired, you can ask the court to bring it back. You must file the motion yourself as the plaintiff. You must show good cause for filing after it expired and that you filed within a reasonable time. Good cause can include a prior dismissal because the defendant could not be served. The court can reinstate the order until a hearing, then decide whether to extend it to protect you or your child.

Final orders capped at two years

Final protection from abuse orders now last no more than 2 years by default. The court may extend or reinstate an order later under the law. This sets a clear time limit unless the court finds more protection is needed.
