New penalties for prison contraband

The law makes trafficking in prison contraband a Class C crime. When the item is an unauthorized cellphone or other handheld communication device, and it was not meant to help commit another crime, it is Class D. Electronic contraband means a mobile phone or similar handheld device not authorized or issued by the custodial authority.

Crimes for tobacco and vapes in jails

In adult jails and prisons that ban them, it is a Class E crime to give or try to give tobacco, tobacco products, or a vaping device to a prisoner. It is also a Class E crime for a prisoner there to get or have them. An adult correctional facility means a county jail or other adult facility run by the Department of Corrections, not a juvenile facility. A vaping device includes vapes and e-cigarettes used to inhale any substance, including controlled drugs.
