New pollution warnings for downstream communities

After reporting a discharge to Minnesota's Pollution Control Agency, public treatment plant owners must promptly warn potentially affected downstream users. This also applies to owners of public or private domestic sewer systems. Those warned must include the public, Tribal governments, and drinking water facilities. Owners must use their most efficient available communication system, such as phone calls, social media, or websites. They must also post signs at all affected public-use areas within the same jurisdiction or notify the authority responsible for those areas. Notices must give the discharge date and time, material released, potential health risk, and permit holder's contact information. The agency must provide guidance on timely notices, including methods and procedures. Existing duties to immediately report potentially polluting discharges, recover released material, and limit pollution as reasonably possible remain. Agency reporting is still not required for petroleum discharges of five gallons or less.
