Bill Overview

Analyzed Economic Effects

5 provisions identified: 3 benefits, 1 costs, 1 mixed.

Debtors gain protection for compelled testimony

Beginning January 1, 2027, compelled statements during judgment-debtor questioning cannot be used against the debtor in a criminal case. Evidence drawn from those statements is also protected. These protections do not bar use in a prosecution for perjury or giving a false statement.

Health savings accounts gain creditor protection

Beginning January 1, 2027, Missouri protects qualifying health savings accounts from creditor claims. The account must qualify under section 223 of the federal tax code. This keeps qualifying account assets from being used to pay creditors.

Higher and lower property protections for debtors

Beginning January 1, 2027, Missouri raises protection from debt collection for household goods from $3,000 to $15,000. Limits fall from $6,000 to $1,700 for other property and from $5,000 to $1,700 for jewelry excluding wedding rings. Vehicle protection rises from $3,000 to $5,000, plus up to $10,000 transferred from unused household-goods protection. The mobile-home limit rises from $5,000 to $12,000 for a main home not attached to land the debtor owns. These limits protect only the debtor’s ownership share. Household goods must mainly serve the personal, family, or household needs of the debtor or a dependent.

Debtor property protections track consumer prices

Beginning April 1, 2029, Missouri adjusts personal-property and homestead protection amounts every three years based on consumer price changes. Adjustments use CPI-U changes over the three years ending just before the preceding January 1. Amounts are rounded to the nearest $25. The Revisor of Statutes must publish them by March 1 before each April adjustment. New amounts apply only to cases started on or after the adjustment date, not cases already underway.

Creditors gain easier access to debtor questioning

Beginning January 1, 2027, creditors can request court-ordered questioning of judgment debtors, or a corporate debtor’s chief officer, under oath. Creditors no longer need a failed collection attempt first, and the former five-year deadline after that attempt is removed. Requests must come before the judgment is recorded as satisfied or legally presumed paid. Courts can compel attendance and use contempt powers for noncompliance.
