Some goods exempt from ADF fees

Items already taxed under 4 CMC § 1405 are not charged ADFs. If you import or sell these taxed items, you do not pay the new disposal fees on them.

Environmental fund pays recycling costs

All ADF money goes into a new Environmental Management Fund. The Secretary of DPW, with the Director of Solid Waste Management, approves spending. The fund can pay for operations, contracts with private collectors and processors, payments to recyclers, facilities and equipment, off‑island shipping, market development and startup grants, education and outreach, staff support, administration, and training.

New recycling duties for importers

Importers and wholesalers must help collect and redeem covered materials. They need agreements with retailers or buyback contracts with permitted recyclers. DPW rules set how ADFs are paid, how to keep accounts, and how audits work. DEQ or DPW can inspect records and premises and require recordkeeping. Businesses that do not follow the rules can face administrative penalties under existing law.

DPW sets recycling fees and rules

The Department of Public Works now runs the advance disposal fee (ADF) program. DPW sets which materials are covered using clear criteria like toxicity, market demand, and ease of collection. It must write material‑specific rules, and it can manage related materials together. Fees must fully fund the program, including collection, processing, shipping, public education, admin, and return incentives, minus any money from selling materials.
