Penalties for disorderly conduct and intoxication

The law makes lewd acts, or asking for them, in public a misdemeanor. It bans loitering in or around public toilets to do or ask for lewd or illegal acts. It bans lodging in any public building, structure, vehicle, or place without the owner’s permission. It bans being in public while intoxicated if you cannot care for yourself, endanger others or property, or block streets or sidewalks. Lewd acts include touching, fondling, and masturbation; loiter means lingering without a lawful purpose to commit a crime; public places include sidewalks, squares, malls, parking lots, streets, and beaches in central Garapan and tourist sites the Marianas Visitors Authority recognizes. A first conviction can bring a fine up to $500 and up to 30 days in jail; a later conviction can bring a fine up to $2,000 and up to one year in jail.

Tighter rules on street solicitation at tourist sites

The law makes it a crime to follow, touch, shout at, or try to stop people on public streets or tourist sites to sell or promote for money. It also bans handing out fliers or handbills for a fee or following someone to push commercial materials. Public thoroughfares include sidewalks, squares, malls, parking lots, streets, and beaches. Tourist sites are those recognized by the Marianas Visitors Authority. A first conviction lists a fine as “not more than $500 $4000” and up to 30 days in jail. A later conviction allows a fine up to $1,000 and up to one year in jail.
