Beginning July 1, 2025, Mississippi and its agencies cannot seek Medicaid repayment from Mississippi ABLE disability savings accounts. These accounts and their proceeds are excluded from Medicaid recovery after the beneficiary dies. They are also excluded from the rule transferring small, unclaimed Medicaid recipient funds to the state. These protections apply except where federal Medicaid recovery law requires otherwise.
