Agents appointed by the Montana Attorney General are peace officers. They must help city, county, state, and federal law enforcement when asked, following rules set by the Montana Department of Justice. They also help with law enforcement training schools in Montana when asked and when they can.
Attorney General agents now share jurisdiction with local police for key crimes. They can investigate dangerous drugs, organized crime, human trafficking, and prostitution or patronizing a prostitute. They also handle internet crimes against children, defined as using devices or online messages to commit or help commit sexual or exploitation crimes against a child, including sexual assault, sexual intercourse without consent, indecent exposure, aggravated sexual intercourse without consent, sexual abuse of children, and child sex trafficking. This adds state resources for trafficking and child protection cases. It may also increase investigations of prostitution offenses.
Attorney General agents must investigate gambling activities under state law. They must investigate possible crimes found by legislative audits of state agencies. They must also investigate criminal referrals from the state workers’ compensation insurance fund. This increases oversight and may mean more investigations for people and businesses linked to these areas.
