Right to sue for privacy violations

If you meet an opposite-sex person in a restroom or changing room labeled for your sex, you can sue the covered entity that allowed it or failed to stop it. If a covered entity makes you share sleeping quarters with the opposite sex, you can sue, too. You may ask for a court order, a statement that the law was broken, nominal damages, and other relief. You must file within 2 years of the violation. If you win, the court can make the entity pay your reasonable attorney fees and costs.

Separate school sleeping and undressing areas

At public school events with shared sleeping quarters, students cannot be required to share with the opposite sex, unless it is a family member. In any school place where people may be undressed with others, staff must provide separate, private areas by sex. Only members of that sex may enter those private areas, except for custodial or maintenance work, medical or law enforcement help, or emergencies.

Sex-specific restrooms in public facilities

Covered entities, including public buildings, public schools, correctional and juvenile facilities, and some local domestic violence programs, must label every multi-occupancy restroom, changing room, and sleeping area for males or females. People may use only the space for their sex, with entry by the other sex allowed only for custodial or maintenance work, medical or law enforcement help, or emergencies. Covered entities must take reasonable steps to give privacy from the opposite sex. For these rules, the law defines sex as male or female and sets key terms like restroom, changing room, and covered entity. Entities may offer single-occupancy or family rooms, make ADA, child, and elderly accommodations, and redesignate a space to the other sex.
