Montana can charge people facing immigration detention

The law lets Montana file state criminal charges against someone who is in, or may face, federal immigration detention for crimes done in Montana. If a state case is pending, Montana can hand the person to federal immigration officials on request or keep the person until the state trial and sentence are finished. Before a local prosecutor declines such a case, they must notify the Montana Attorney General so the Attorney General can choose to start the prosecution.
