The law fines groups that plan crimes against critical sites. An organization in a conspiracy with offenders can be convicted. The fine can be up to 10 times the fine for the underlying crime.
The law sets tough penalties for trespass and damage at protected sites. If you willfully trespass at a fenced or posted critical site to harm equipment or operations, it is a felony. A court can fine up to $4,500 and jail up to 18 months. If you damage equipment under $1,500, it is a misdemeanor. The court can jail up to 6 months, fine up to $500, and order restitution. If damage is over $1,500, it is a felony with up to a $150,000 fine and up to 30 years in prison.
The law defines critical infrastructure and critical facilities. It lists sites like power plants, substations, pipelines, water plants, telecom hubs, ports, rail yards, prisons, military bases, and chemical plants. Many sites are covered only when fenced or clearly posted to keep out intruders. Construction sites and posted parts of pipelines and tanks are also covered. This clarifies which places get special protection under state law.
