During a lawful stop, a Montana peace officer may try to determine a person’s immigration status. The officer must have reasonable suspicion and only do this when practical. The officer does not run the check if it would hinder or block the investigation. If the person is not lawfully present, the officer must report it to a federal immigration agency.
