Stronger anti-bias rules for school admissions

The law bans schools from denying admission, expelling, or limiting students because of race, religion, sex, marital status, age, disability, or national origin. Schools cannot use quotas or policies that limit a group’s chances. Schools cannot ask for or keep records of those traits in applications, unless allowed by the commission’s rules. Schools cannot publish ads or catalogs that show discriminatory limits. Decisions based on reasonable grounds related to a mental disability are still allowed.

Male students barred from female teams

Schools cannot let a person whose sex is male play on teams or in activities designated for females. This rule applies to school athletic programs across Montana.

Single-sex access rules for school facilities

Schools must give you access to restrooms, locker rooms, showers, and sleeping areas that people of the opposite sex cannot enter while you use them. This does not apply to custodial or maintenance work, medical aid, or emergencies. Schools may offer single-occupancy or family facilities and make ADA, child, or elder care accommodations. Schools may also redesignate multi-occupancy spaces from one sex to the other.

Student speech on names and sex

Students may call another student by that student’s legal name or refer to that student’s sex. These acts are not unlawful discrimination under this law.
