New speed limits on Montana roads

Montana sets speed limits by road type. Interstates outside an urbanized area of 50,000+ are 80 mph; inside those areas they are 65 mph. On four-lane national highway stretches 10+ miles long with no permanent special speed zone, limits are 75 mph in daytime and 70 mph at night. All other public highways are 70 mph in daytime and 65 mph at night; in urban districts the limit is 25 mph. Daytime is 30 minutes before sunrise to 30 minutes after sunset; other hours are nighttime. You may go up to 10 mph over the limit only to pass on a two-lane road in a marked passing zone and then return safely.

New speeding fines and record rules

The law sets new civil fines for speeding. On rural interstates under 61-8-303(1)(a), fines are $40 (1–10 mph over), $70 (11–20), $120 (21–30), and $200 (31+). On other listed roads, fines are $20 (1–10 over), $70 (11–20), $120 (21–30), and $200 (31+). Minor overages are not criminal and usually are not recorded: up to 10 mph over in daytime or 5 mph at night. But driving over 90 mph on 61-8-303(1)(a) may go on your record and affect insurance. The law bars the 3-1-317 surcharge, but record protections do not apply to CDL holders, out‑of‑state reports, or special speed zones.
