Standard ballots and faster emergency polling

Within 5 days of a valid request, the Secretary of State sends each legislator a certified-mail ballot. The ballot lists the requesting legislators, the reasons and purposes, the draft bills, and the proposed convening date and time. It sets a return deadline no more than 30 days after mailing and includes a stamped return envelope. For a declared emergency or disaster under 10-3-303, ballots go out within 2 calendar days by any reliable means, including electronic delivery, without certified mail. In that case, the return deadline is no more than 7 calendar days after sending.

30 lawmakers needed to request special-session poll

The law raises the bar to start a special-session poll. At least 30 legislators must jointly ask the Secretary of State, up from 10. Their written request must explain the conditions and purposes, attach draft bills prepared by the Legislative Services Division, and list the proposed date and time to convene. Any legislator may ask Legislative Services staff to draft the bills needed for the request.
