Uniform child support rules for parents

The Department of Public Health and Human Services adopts one uniform child support guideline. Courts use it to set minimum child support amounts. Before adoption, the department notifies the Montana Supreme Court, district courts, and the State Bar. The guideline must consider factors in Montana law about income, expenses, and parenting time. At least every four years, the department reviews the guideline, uses a certified public accountant when needed, and can propose changes to the legislature.

New child support review committee

The law creates a child support guidelines review committee in the department. It meets at least every quarter. It researches, develops, and recommends policy changes for the guideline. The department appoints members and follows federal rules. The committee must include one outside child support expert and one person with lived experience. Public members serve without pay but can get expense reimbursement under state law if money is available.
