New return-to-work rules for retired teachers

Beginning July 1, 2025, retired members of the Montana Teachers’ Retirement System must take a break before working in a TRS-reportable job. If your termination date was Jan 1, 2014–Dec 31, 2023, the break is 150 calendar days; for Jan 1, 2024 or later, the break is 120 days. During the break, you may work up to 45 days as a substitute classroom teacher (covering a licensed teacher’s temporary absence) or as a mentor to newly hired teachers. You may also keep a job that was properly reported to the Public Employees’ Retirement System before and at the time of retirement. TRS treats work done through a PEO, temp or leasing firm, or as an independent contractor as reportable employment. If you violate the break rules, your retirement status ends and you return to active membership retroactively. You must repay all retirement checks with interest, and both you and the employer owe TRS contributions on pay earned during the break, plus interest.

When these teacher retirement rules apply

The law takes effect July 1, 2025. Some temporary parts now end June 30, 2027. The rest end June 30, 2029. These dates control when the return-to-work rules start and how long the temporary versions remain in place.
