Pregnancy centers can sue for $50,000

In Montana, pregnancy centers or others harmed can sue over violations of this law. Winners get actual damages or at least $50,000, plus attorney fees and costs. If the defendant acted with malice, the court may triple the damages. Courts can also issue orders to stop violations.

Law takes effect on approval

The law takes effect when the Governor signs it. All protections and remedies apply from that date.

Legislature can join court fights

The Montana Legislature can join court cases that challenge this law. By joint resolution, it may appoint a sponsor or cosponsor to intervene as of right. The member acts in an official role.

Pregnancy centers protected on services and staff

Montana cannot make pregnancy centers perform or promote abortion or contraception. The law bars forcing them to give abortion drugs, contraception, referrals, counseling, or ads. Montana cannot block them from offering pregnancy help because they refuse abortion or contraception. Help can include classes, diapers, formula, medical tests, counseling, and information on reversing abortion drugs. The state also cannot force centers to hire or keep staff who do not follow their mission.
