Beginning July 1, 2025, penalties rise for indecent exposure. First offense: up to a $500 fine or 6 months in county jail; second: up to a $1,000 fine or 1 year; third or later: up to a $10,000 fine or up to 10 years in state prison. If the act is seen by someone under 16 and the offender is more than 4 years older, the crime is aggravated. Conviction can bring up to a $50,000 fine and 4 to 100 years in state prison. A judge can give less than 4 years with a written finding of good cause.
Starting July 1, 2025, some indecent exposure crimes count as sexual offenses. Third-or-later indecent exposure and indecent exposure to a minor qualify. Attempts, solicitations, conspiracies, and juvenile adjudications count too. This can require registration and other sex offender rules.
Starting July 1, 2025, the law defines indecent exposure more clearly. It covers exposing genitals or intimate parts by any means, including electronic messages. The person must know it is likely to cause affront or alarm and intend to humiliate, harass, degrade, or arouse.
Starting July 1, 2025, prosecutors may not charge a minor who was being helped by a parent or guardian under this section. They also may not charge a person who is developmentally disabled.
