Undersheriff pay set at 98% of sheriff’s salary

The law sets an undersheriff’s base pay at 98% of the sheriff’s salary. Counties must use this formula. The sheriff’s salary is the statutory amount set in Montana law.

Deputy pay tied to sheriff and county size

Deputy sheriffs’ base pay is a percent of the sheriff’s salary. The percent depends on county population: under 15,000 people, 85% to 95%; 15,000 to 29,999, 76% to 95%; 30,000 to 74,999, 74% to 95%; 75,000 and over, 72% to 95%. The sheriff sets each deputy’s percent within the range based on rank. These ranges act as both a floor and a cap.

Base pay excludes overtime and longevity

For these pay rules, compensation means base pay only. Longevity pay and overtime do not count in that base. The law also defines the salary of the sheriff as the total sheriff salary set elsewhere in Montana law.
