Cap on required parking for homes

Beginning Oct 1, 2026, zoning cannot require more than one off‑street parking space per home. For homes under 1,200 square feet, the cap is one‑half space per unit. In urban municipalities over 5,000, cities may count shared‑parking agreements toward the cap. Local governments using Part 25 must follow the same one‑space limit. ADA‑accessible spaces are still required, and owners may build more parking if they choose.

Duplexes and apartments allowed in cities

Beginning Oct 1, 2026, cities with 5,000 or more people must allow duplexes on any lot that allows a single‑family home. Duplex rules cannot be stricter than single‑family rules. In urban municipalities over 5,000, commercial lots with will‑serve letters for water and sewer must allow apartments and mixed‑use buildings that include homes. This opens more places to build housing.

No minimums for child care and affordable homes

Beginning Oct 1, 2026, cities cannot set any minimum parking for: existing buildings, including vacant ones changing use; licensed or registered child‑care; deed‑restricted affordable homes; and assisted living facilities. When a local government acts under Part 25, units under 1,200 square feet also face no parking minimums. ADA‑accessible spaces are still required. This can lower costs for parents, low‑income renters, seniors, and building owners.

When these zoning changes start

The law’s zoning and parking rules start October 1, 2026. From that date, cities, towns, developers, and property owners must follow these changes.
