In an involuntary termination of parental rights case under 42-2-607, the court can order a public defender for a parent. The court can assign a lawyer only after the parent is found indigent under 47-1-111. The assignment happens by court order. This applies starting July 1, 2025.
For treatment courts under 46-1-1104 or 46-1-1204, the judge can order a public defender to serve on the team. The assignment is made by court order. This change starts July 1, 2025.
The law takes effect July 1, 2025. All parts start then unless another section sets a different date or sunset.
