Stable mine cleanup funding through 2038

Beginning July 1, 2025, the state splits key cleanup money 50/50 each year: half to the Libby asbestos cleanup and half to abandoned metal mine projects. Each year, $500,000 goes first to the CR Kendall site for long-term care and water treatment before the metal mine share. After the required biennial deposit and if funds remain, the state transfers $1.2 million a year from the orphan share to the long‑term water treatment trust and $1.2 million a year to the environmental quality protection fund. The state board of investments may limit these transfers. These rules stay in place through June 30, 2038, and the act ends on that date.

Easier private help for cleanups

Starting July 1, 2025, the state creates an account to hold private donations to fix a specific pollution release at a specific site. Interest stays in the account. The agency holds funds until the balance is enough for the cleanup, or returns the money plus interest after one year if it is not enough. People can also donate services for a specific cleanup. Donors are not liable just for donating, but can be liable for negligent, grossly negligent, or intentional misconduct. Existing liable parties cannot escape their duty, and donated work must be approved for the cleanup.
