No noncompetes for healthcare providers

Beginning January 1, 2026, new or renewed contracts cannot block covered providers from practicing after they leave. Employers cannot stop you from working anywhere, for any length of time, once the job ends. They also cannot stop you from treating, advising, consulting with, or forming relationships with current patients of your former practice. They cannot forbid you from asking or advertising to those patients. Covered providers include psychiatrists or addiction medicine physicians, psychologists, social workers, professional counselors, addiction counselors, marriage and family therapists, and peer support specialists.

Exceptions for practice sales and paybacks

Beginning January 1, 2026, contracts tied to selling or buying a medical practice can still include post‑employment practice limits. Repayment terms for physicians licensed under Title 37, chapter 3 remain enforceable if the payback amount decreases over time. Examples include bona fide loans, relocation costs, signing bonuses, education expenses, and tuition repayment.
