State agencies cannot require diversity statements

State and local agencies cannot require, request, or compel a diversity statement. They also cannot give extra credit to anyone who submits one in hiring, admissions, contracts, or other decisions. If federal law requires a diversity statement, an agency accepts and uses it only as much as that federal rule requires. Agencies can still set policies needed to follow anti-discrimination and harassment laws. A “diversity statement” means a document that promotes different treatment based on race, color, ethnicity, sex, sexual orientation, national origin, religion, or gender identity. These rules cover state departments, boards, colleges, cities, counties, school districts, and similar bodies.
