Beginning July 1, 2025, the state provides $6 million for the 2025–27 biennium to repay counties for certain jail holds. The money only covers people awaiting court-ordered evaluation or examination, or committed to DPHHS and waiting for placement. DPHHS reimburses counties at 135% of a large private provider’s daily rate.
The law sets who pays for people held in Montana jails. If the arresting agency does not run the jail, it pays, unless both sides agree otherwise. Exceptions in 7-32-2245 apply. Counties pay when a city commits someone for reasons other than pretrial or an ordinance sentence, and for DOC probation violators from their court. After sentencing, the Department of Corrections pays the costs. Jails get paid by sending a claim to the arresting agency; payment goes to the jail’s government unit or approved private operator. The daily “actual cost” is the higher of 90% of the private provider rate or $82. If the person is a fugitive wanted by another state, that state pays, including medical bills. These rules end June 30, 2027.
