County commissioners can ask a court to order certain local government bodies or their members to act or stop an act. This does not apply to counties, consolidated city-counties, cities or towns, or school districts. Commissioners can hire outside lawyers for these cases, and a court decides if attorney fees and costs are awarded. Disobeying a court’s peremptory writ can bring a fine up to $1,000 and jail until the order is obeyed. If an elected or appointed official is found in contempt for ignoring the writ, that official can face recall under state law.
