Lawsuit deadlines for minor transition care

The law sets special time limits for injury claims about gender transition care received as a minor. You must file within 25 years after you turn 18 or within 4 years after you discover the injury and its cause, whichever is later. The law also bars any claim filed after you reach age 30. These rules replace the normal 3‑year tort and 2‑year medical malpractice deadlines for these cases. The law defines which surgeries, puberty blockers, and high‑dose hormones count as gender transition treatment for these rules.

Medicaid must match detransition coverage

If Montana Medicaid covers gender transition care or related care, it must also cover detransition care on the same cost‑sharing terms. If Medicaid later stops covering transition care, only people who were enrolled and who used that coverage keep equivalent detransition coverage.

Private plans must cover detransition care

If your group or individual health plan covers gender transition care or related care, it must also cover detransition care with the same copays and rules. This parity applies to HMOs and regulated self‑funded MEWAs, too. If a plan later drops transition coverage, only people who were enrolled and who used that coverage keep equivalent detransition coverage.

State and university plans cover detransition

State employee and Montana university system plans that cover gender transition care must also cover detransition care on the same terms. Copays and cost‑sharing must match. If these plans later stop covering transition care, only members who were enrolled and who used that coverage keep equivalent detransition coverage.

State health program covers detransition

If the state health program covers gender transition care or related care, it must also cover detransition care with the same cost‑sharing. If the program later drops transition care, only people who were enrolled and who used that coverage keep equivalent detransition coverage.
