New filings and fees for nuclear projects

Applicants to the Federal Energy Regulatory Commission or the U.S. Nuclear Regulatory Commission must give the Department of Environmental Quality a notice and a copy of the federal application when they file. You must also pay a fee to the department at that time. The fee funds the state’s review and its participation in federal proceedings. The fee is capped at no more than half of Montana’s general siting-fee limit, and you are not charged both fees. If you file late and that prevents the department from meeting deadlines, you face penalties under state law.

New siting rules for uranium facilities

Montana authorizes siting of uranium conversion and enrichment facilities. A facility is allowed only if it converts and enriches uranium on site, gets a state recommendation from the Department of Environmental Quality, and holds a U.S. Nuclear Regulatory Commission license. The Department of Environmental Quality must file a state recommendation with the federal commission for these projects, based on its review. Conversion means turning natural uranium oxide into uranium hexafluoride. Enrichment uses gaseous diffusion, gas centrifuges, or laser isotope separation.
