Judges can subpoena in child-exploitation cases

A Montana Supreme Court justice or a district judge can issue subpoenas in child-exploitation investigations. The case must involve sexual exploitation of a minor. An ICAC officer must file an affidavit saying justice requires it. Subpoenas can force testimony and records. Allowed records include name, address, email, username, phone, IP, account status, and payment source. They can also require internet access method and automatic number identification if access is by modem. An ICAC officer is a Montana peace officer on a DOJ-recognized ICAC task force.

New five-member judicial standards commission

The law creates a five-member Judicial Standards Commission. Two district judges are appointed by the Speaker, with Senate confirmation. One Montana attorney with 10 years is appointed by the Attorney General, with Senate confirmation. Two citizens, not attorneys or judges, are appointed by the Governor, with Senate confirmation. Members serve staggered four-year terms.

Supreme Court sets civil procedure rules

The Montana Supreme Court sets rules for civil cases in all state courts. Rules cover pleadings, practice, procedure, and forms. Rules must simplify cases and speed decisions. Rules cannot change anyone’s substantive legal rights. Rules must not conflict with the Montana Constitution.
