State publishes yearly born-alive totals

The department publishes a statewide summary by June 30 each year. The report shows how many abortions in the prior year led to a live birth and updates past years for late or corrected reports. The report must not include details that could identify any person who provided information.

Facilities must report infants born alive yearly

Medical facilities where an infant is born alive after an abortion or attempted abortion must file a yearly report. The report is due to the department by February 28 for the prior calendar year, even if the count is zero. It must list each infant’s gestational age using these ranges: under 9 weeks; 9-10; 11-12; 13-15; 16-20; 21-24; 25-30; 31-36; or 37 weeks to term. It must state the medical steps taken to preserve life, the outcome (survival or death and where death happened, if known), and medical conditions before and after the attempted abortion. The department provides a standard form and may set rules for how to file.

Fines for late or missing reports

The department can fine a medical facility up to $500 if a required report is over 30 days late. It can add up to $500 more for each extra 30-day period it stays late. If a report is still missing after one year, or an incomplete report is not fixed in that time, the department can sue to force the report.
