Lenders must treat declared homes as real property

Once your manufactured home is declared an improvement to real property, the state and lenders must treat it like any other house. This can help you use mortgage-style loans and standard real estate processes.

Alternate path for older homes without tags

If your manufactured home was built before October 1, 2005 and the factory ID tags are missing, you still can have it treated as real property. Remove the running gear and place it on a permanent foundation on qualifying land. Record the Department of Revenue form with the county. You must also show Department of Revenue records that it has been taxed as real property for at least one year.

Convert your manufactured home to real property

The law lets you convert a qualifying manufactured home into real property for taxes. You must remove the running gear and attach the home to a permanent foundation on land you own, are buying, or have the landowner’s permission. You must record a statement of intent with the county clerk on the Department of Justice form, then surrender the title or certificate. After the county gets the required fee, the treasurer has 10 days to update the electronic title, give you a receipt, and send the paperwork to the Department of Justice. The Department of Justice then issues a recordable statement showing the title-surrender is complete.

Pay taxes first, moving is limited

You must pay all taxes, interest, and penalties on the manufactured home before the county issues the transaction receipt. After the intent and title-acceptance statements are recorded, you may not move the home unless you follow Montana law 15-1-118. You also pay a required fee; the county sends that fee to the state general fund.
