Private speech and employee attire protected

The law does not limit private speech or personal beliefs outside official government displays. Government employees may wear personal clothing, jewelry, or accessories, unless a uniform or official dress code says otherwise. These carve‑outs do not change the limits on official displays.

New limits on flags at government sites

The law limits flag and banner displays on government property to a set list. A "flag" can be physical or digital. Allowed flags include the U.S., Montana, and local government flags; school district, university, and community college flags. Also allowed: any U.S. state; federally recognized tribal nations and foreign nations; and U.S. military branch and unit flags. Official historical U.S. and Montana flags (like Betsy Ross and Gadsden), the POW/MIA flag, school mascot flags, and official law‑enforcement flags are allowed. Flags on state property that express a political viewpoint are banned, but that ban does not cover flags recognizing official governments, law enforcement, the military, or public service groups. The rules cover buildings, grounds, vehicles, uniforms, and other state or local property, including public schools and colleges. The law takes effect on passage and approval.
