If your emotional support animal damages the home or hurts someone, you must pay the costs. You are responsible for repairs or injury bills.
If your need is not obvious, the landlord can ask for information that shows why you need that specific animal. Only a licensed mental health professional who has treated you for at least 30 days can write it, after a clinical evaluation. The letter must include the date, the provider’s license number, and license type. Online or commercial animal registrations are not enough proof. You must show that each animal meets local license and vaccination rules, and give separate info for each animal. Landlords cannot require your diagnosis, how severe it is, or your medical records. This law defines an emotional support animal and makes clear that service animals follow separate rules. State boards can discipline providers who break these rules.
The law lets tenants with a disability ask to keep an emotional support animal as a housing accommodation. A landlord can deny only if the animal is a direct threat to people or will cause serious property damage that another reasonable step cannot fix. Giving documentation alone does not force a landlord or business to allow the animal if they follow other laws. After you submit the requested information, the landlord must send a written decision.
