New licensing rules for youth treatment centers

The law requires the health department to license residential treatment centers for youth who need 24-hour mental health care. To keep a license, a center must be accredited by a CMS‑approved accreditor. Rules set staff-to-patient ratios, staff qualifications and training, suicide prevention, abuse reporting, insurance, and fingerprint background checks for anyone with regular access to patients. The department may issue a 6‑month provisional license and one more 6‑month license; total provisional time cannot exceed one year. A center is defined as a program for youth under 19 that provides counseling, assessment, nursing, medication management, and related behavioral health care under one set of state standards aligned with related child treatment laws.

School funding rules for kids in treatment

The Superintendent of Public Instruction sets rules for how tuition is calculated and funds are distributed when a child is placed in a qualifying treatment setting. The rules decide which school or facility is responsible for education costs and services. An eligible child is a Montana resident who is under 19 on September 10, has a serious emotional disturbance, and is placed in a qualifying facility in Montana. Qualifying facilities include children's psychiatric hospitals, residential treatment facilities or centers, and therapeutic group homes.
